Privacy Policy

This Privacy Notice (Policy, Privacy Policy) is the property of AZTEK APPS, S.A. DE C.V. (Aztek, Unitii, we, us), a company duly incorporated in the United Mexican States. This Policy describes how Aztek collects personal information from Users and participants of Unitii (Unitii). It will also describe how Aztek uses and discloses the information and how it protects it on its behalf. You (User/player) accept this Policy by downloading, accessing, and/or using Unitii. You can access Unitii either through the mobile apps or the website aztek.com (collectively "Platform/Unitii"). For the purposes hereof, "Law" refers to the Federal Law on the Protection of Personal Data Held by Private Parties.

1. PERSONAL DATA WE COLLECT

The information we collect about you can be obtained directly each time you access Unitii, whether by creating a profile on the Platform, downloading the mobile apps, or browsing the website.

We may also obtain information from third-party providers (Third Parties), partner companies, and/or affiliates.

The information we collect directly from you once you download the mobile apps and create a profile to access Unitii is as follows:

  • Account Information - Such as full name, date of birth, email address, usernames, passwords, and any additional information we deem necessary.
  • Professional Information – This section is divided into two subsections: one will contain publicly visible information for all other Users of the Platform, and the other will contain private information only visible to the User who provides it and to Unitii. Both sections will be visible to Unitii. The information collected for these purposes will be as follows:
    • Public Section - In this section, the User may display all their professional information, which may include but is not limited to, professional experience, previous jobs, education level, languages spoken, country of residence, among others. The User may upload their resume ("CV"), in which contact details should be removed, as an attachment visible to all Users.
    • Private Section - In this section, the User may display their contact details such as address, email, phone number, etc. In this section, the User must also indicate the business areas they wish to engage with through Unitii. The private information will be used by Unitii to establish business connections with other Users as per the operational process outlined in the terms and conditions (link to T&Cs).
  • Device Information - The type of device used to access the Platform, the IP address, the country or region from which you access, and any additional information we deem necessary.
  • Official Identity Document - In some cases, we may ask you to upload a valid, internationally recognized official identity document to verify the information provided. In this regard, we may also ask you to capture an image of your face showing the previously uploaded official identification.
  • Communication with Us - If you contact us directly by email or within the app messages, we will collect and store the information provided in these communications.
  • If you choose to sign up using your Facebook, Instagram, Apple, and/or Google profile, we will collect the information you have provided directly to sign up, as well as the general profile information.

The aforementioned information will be collected directly from us, but may also be collected as you use the Platform, and it will not necessarily be obtained by directly asking you for it. This automatically collected information may include the previously mentioned and also the following:

  • General Device Information - Information about the device you use to access the Platform, such as the user ID or IP address.
  • Your Progress within the Platform - Tracking your progress within the platform.
  • In-App Advertising Interaction - Any interaction with in-app advertisements presented to you. If you interact with any of the ads, we will collect and store that information for future ads.

The information we collect from third parties may come from the following providers:

  • Mobile app stores such as Apple Store or Google Play.
  • Social media companies like Facebook and/or Instagram in case you decide to register or log in through these platforms.
  • Advertising and marketing companies we use for in-app advertising, which may include, without limitation, your participation in the Platform and your interactions with third-party platforms or websites. For more information, see section 4.
  • Any other Third Party with whom we may establish relationships in the future.

2. CONSENT

Consent from the data subjects regarding the privacy notice will be tacitly given once the data subject accesses the platform and/or downloads any of the programs or services offered therein, or when creating a user account or providing information via the "contact us" section. If you have any questions regarding the content of the privacy notice, you can express them via the following email address: support@unitii.com, where we will be happy to attend to each and every one of your inquiries. It will not be necessary to obtain your knowledge for the processing of your personal data under the assumptions set forth in Articles 10 and 37 of the Law. If it becomes necessary for “THE RESPONSIBLE PARTY” to process sensitive data, you will be notified via the email address you provided in your account. We will send you a detailed explanation of the purposes for processing such data, and request your consent through any authentication method established for this purpose, all in order to comply with the provisions of Article 9 of the Law.

3. PURPOSES OF DATA PROCESSING:

“THE RESPONSIBLE PARTY” processes your personal data always in observance of the principles of: legality, consent, information, quality, purpose, fairness, proportionality, and responsibility, as outlined in Article 6 of the Law. Below is the information that “THE RESPONSIBLE PARTY” obtains from “THE DATA SUBJECTS”, as well as the purposes for handling their personal data; if these purposes are modified, we will send you a notification indicating such changes and once again requesting your consent, in compliance with the provisions of Article 12 of the Law. Data that “THE RESPONSIBLE PARTY” obtains from the data subjects: There are two ways in which Aztek can collect information from users: through the Platform or through the products or services offered therein. The information that will be collected directly from you is described in section 1 of this document. Similarly, the data subject may access the Platform via Google, Apple, Facebook, or any other third-party platform that allows access to the Platform, and by doing so, the data subject agrees to provide the requested information, which will be transferred by the third parties to Aztek. In the event that you directly contact Aztek through the platform for any purpose, you agree that we may collect additional information to fulfill your request or provide the required support. All information collected from you will be stored by Aztek in electronic files, and all appropriate security measures will be taken to protect your information.

Aztek collects the information listed above with the following purposes:

  • Allow you to access the Aztek Platform and use it.
  • Provide specialized customer service.
  • Keep the information available at any time.

4. OPTIONS AND MEANS PROVIDED BY THE RESPONSIBLE PARTY TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA

Feel confident in providing us with your personal data, as we have implemented administrative, technical, and physical security measures to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access, or processing, as stipulated in Article 19 of the Law. If there is any type of data breach during any phase of processing that significantly violates any moral or financial rights, we are committed to notifying you as soon as possible through your account or email address provided, so you can take appropriate measures as deemed necessary and in respect of your rights under Article 20 of the Law. You can limit the use or disclosure of your personal data by sending your request to the Aztek Department at the address: Av. Jesús del Monte #41, Col. Jesus del Monte, Huixquilucan, Estado de México, C.P. 52764, or you may contact the Department directly via email: support@unitii.com. If your request is valid, the Department will contact you within a maximum period of ten days and will inform you of the appropriate action.

5. EXERCISE OF ACCESS, RECTIFICATION, CANCELLATION, AND OBJECTION RIGHTS

In accordance with the Law, specifically Article 28, the data subject may at any time access their personal data either through the Responsible Party's website under the user section or by email at support@unitii.com. To make any rectifications, the user can do so through the Responsible Party's website or by emailing support@unitii.com. If the user wishes to request a rectification, cancellation, or objection, they must provide their full name, as well as a clear and precise description of the personal data to which they wish to exercise their rights regarding rectification, cancellation, or objection to the personal data provided during registration in the platform, in accordance with Article 29 of the aforementioned Law. The Responsible Party will have a maximum of 20 days, as established in Article 32 of the Law, starting from the date the request is received from the data subject. If the rectification, cancellation, or opposition request is valid, the Responsible Party will have a maximum of 15 days from the date the response was given to the data subject to carry out the requested action. The aforementioned periods may be extended by an equal period if properly justified and circumstances so require. Regarding simple access to the information, it can be requested through the Responsible Party's website or by email at support@unitii.com. If the user chooses to request access to the information via email, they must verify their identity through the security measures established by the Responsible Party. Once this data is verified, the Responsible Party will provide the requested information to the data subject.

The Responsible Party may deny the data subject access to the information, or the ability to make rectifications, cancellations, or objections in the following cases, in accordance with Article 34 of the Law:

  • When the requester is not the data subject.
  • When the requested personal data is not found in their database.
  • When third-party data is compromised.
  • When there is a legal impediment or a resolution by a competent authority that restricts access, rectification, cancellation, or objection to personal data.
  • When the rectification, cancellation, or opposition has already been made previously.

In all the aforementioned cases, the Responsible Party must inform the user of the reasons for denying the request. The request for access to personal data, once the identity has been properly verified, will be free of charge, as stated in Article 35 of the Law.

6. HOW WE USE YOUR INFORMATION

At Aztek, we are fully committed to safeguarding and protecting your information. For this reason, we have implemented all possible physical, technological, and administrative measures on our servers to protect your information. We constantly strive to improve these safeguards to keep your information secure and help you continue enjoying the Platform. Aztek will always use your information for your benefit and to improve the Platform

Below are some of the ways we use the information, without limitation.

  • To help you access the Platform more easily
  • To keep your interactions and connections within the Platform safe
  • To store your profile information
  • To provide you with advertising within the Platform
  • To offer you the best services based on your interests and interactions

The above are just some of the ways in which we may use your information directly to benefit users on the Platform. However, we may use the stored information as we deem necessary in order to improve the experience within the Platform in the future for any additional purpose that we consider necessary, always with the understanding that in addition to the list of ways we can use your information within the Platform, we may also use your information outside the Platform for the following purposes:

  • To subscribe you to the Aztek newsletter and keep you informed of all updates and benefits of the Platform.
  • To process your personal requests within and outside the Platform.
  • To communicate with you by any means for anything you may need or that we believe may be of interest to you.

Without limitation to the above lists, we will use your information to comply with any applicable law or authority requirement. In some cases, we may ask you to provide additional information if we deem it necessary. If so, we will notify you directly of the reasons and the information we need from you.

6.1 ACCESS

As mentioned in the terms and conditions (link to the terms and conditions), the way Unitii facilitates connections between users is through the use of an Artificial Intelligence platform, for which Unitii has only acquired a usage license from the owner of the AI code. Through this platform, the User will make a connection request detailing the business, opportunity, work, and/or any other request related to the operation of Unitii that the User wishes to generate. The User acknowledges and agrees that the information provided for the connections will be analyzed using the Artificial Intelligence through the license obtained by Unitii, with the understanding that the owner of the AI may have access to such information. Once the User makes the connection request and describes in detail what they are looking for, Unitii will analyze it using the Artificial Intelligence and provide the User with the results generated by that search. These results will be different User profiles within Unitii that represent a possible match with what the User requested in the search. Once the connected Users accept the request in accordance with the process established in the terms and conditions (link to the terms and conditions), a private conversation will be initiated between the Users. From that moment onward, Unitii will not be responsible for the information provided in that conversation. This should not be understood to mean that Unitii will not have access to the conversation; it simply means that Unitii does not control the information shared. In this regard, the User agrees to share information in those conversations at their own risk. In the same sense, the User may share their contact details, which until that point were in the private section of the User's profile, with the person they made the connection with, releasing Unitii from any situation that may arise from sharing the contact details. Similarly, the User releases Unitii from any liability that may arise from the relationship established between Users outside the Platform. Therefore, if either User suffers any harm due to the established connection, Unitii will not be held responsible under any circumstances, as it is the responsibility of the Users to ensure the operation is safe, and it will be considered an independent business apart from the connection made within Unitii. Unitii may keep copies of the conversations that Users have within the Platform.

7. WHO WE CAN SHARE YOUR INFORMATION WITH

As mentioned earlier, we constantly work with third-party companies that provide various services to Aztek to ensure the Platform functions properly and to guarantee that Users can use the Platform in the best possible way. To ensure the proper functioning of the Platform, we may disclose your information to the following individuals and/or companies, including but not limited to, and you agree and allow Aztek to do so, always understanding that such disclosure of information will be end-to-end secure and will only be made for your benefit:

  • Affiliated companies, subsidiaries, and/or partners of AZTEK APPS, S.A DE C.V.
  • Service providers of AZTEK APPS, S.A DE C.V. directly related to the operation of the Platform
  • The Artificial Intelligence platform, as determined for the previously established purposes

We may disclose your information to third parties in the following cases:

  • Whenever you expressly authorize us to disclose your information.
  • Whenever we hire or form alliances with any third-party company.
  • To allow Users access to all the features and/or all the content of the Platform.
  • To provide Users with personalized advertising within the Platform, more information disclosed in the "Advertising" section.
  • To partners, employees, directors, affiliated companies, associated companies, and any other entity or individual directly related.
  • To ensure the security of Aztek and the Platform, we may disclose your information to protect the Platform, intellectual property rights, other Users, or any other component of the Platform that needs protection.
  • With various third-party applications that support the system in collecting information about the steps generated by the User.
  • If required by a Government Institution.
  • In compliance with any law or jurisdiction we are obligated to adhere to.

In addition to the above, the Responsible party may transfer the requested information in accordance with Articles 36 and 37 of the Law.

8. ADVERTISING

The Platform and/or Website include advertisements for third-party products and/or services, so whenever you use the Platform, you may see such advertisements. These advertisements are provided to Aztek by an external provider with whom we have shared your information once you created your profile, as permitted in this Policy. The external advertising provider will track and monitor your interaction with the advertisements presented to you, as well as other types of information about you, to improve and specifically target the advertising to your profile. They may also collect additional information from you and share it with us. Aztek may generate revenue from the advertisements shown to you. You may voluntarily view advertisements within the Platform to receive personal benefits within the Platform. The advertising presented on the Platform and/or the website may redirect you to external websites. We are not responsible for the content of such websites or for the protection of your information by them. We also do not guarantee the quality or accuracy of the information, services, and/or products offered in the advertisements.

9. IN-APP PURCHASES

The Platform supports and offers in-app purchases for you to obtain a variety of benefits within the Platform, using Real Money to purchase Virtual Goods (refer to the "Virtual Goods" section in the "Terms"). These in-app purchases will be managed by an external provider to whom you will need to share your personal financial information in order to process your payments. We are not responsible for any loss or damage to your information when it is disclosed directly from you to this third party. You should carefully review their privacy policy.

10. SECURITY AND RIGHT TO EXCLUSION

As mentioned earlier, at Aztek, we strongly believe in protecting our Users and, therefore, their information. This is why we implement all technological and physical safeguards to protect your information in the most complete way we can. If you no longer wish for us to have and process your information, you have the right to completely delete the information we hold about you, understanding that by doing so, your profile and access to the Platform will be removed. If you wish to do so, please contact us at support@unitii.com. If you no longer wish to receive our marketing emails, you can do so by clicking "unsubscribe" in one of the received emails and/or by contacting us at support@unitii.com to inform us of your wish to unsubscribe from the newsletter. In relation to the above, you have the right to submit any request to exercise your rights concerning the processing of your data according to the following bases:

  • As mentioned, completely deleting your account and the information we have stored about you, with the understanding that such an action will result in losing all progress made within the Platform, and any Virtual Goods that you have not spent within the Platform will not be refunded.
  • You have the right to be informed about the information we have stored about you, the additional information we have collected during your use, and the information we have shared with Third-Party providers. Please note that the information we provide in relation to this right may be limited based on the different agreements we may have with Third Parties. Also, keep in mind that we may request additional information if you decide to exercise this right in order to verify that the person requesting such information is authorized to access it, understanding that if we cannot verify that the person requesting the information is authorized to obtain it, we reserve the right to withhold it.
  • You may request that we restrict or delete part of the information we store about you; in cases where the information you request to delete or restrict is essential for us to continue storing or accessing it in order for you to access the Platform, we will deny this request, giving you the option to continue using the Platform as before, granting us full access to your information again, or the option to completely delete your account.
  • You have the right to correct your information if you find that part of the information we have stored about you is incorrect. Please note that if you change the information to something false, we will temporarily suspend your account until the information is corrected again. If the information is not corrected, we may delete your account.

All the rights mentioned above are still subject to investigation on our part, meaning we need to verify the identity of the person making the request and the feasibility of the request. Please note that if we decide to deny your request, we will notify you of the denial, the reasons, and alternative solutions to your request. You will also have the right to "opt-out" of the "sale or sharing" of information for advertising targeting, meaning that if you do not specifically exercise this right, we may transfer and will transfer your information to third parties responsible for customizing the advertising directly to you based on the information we disclose. 11. CHILDREN

The Platform is not accessible to children under the age of 18. If a minor deliberately lies about the information they provide when creating their profile and claims to be older than they actually are, Aztek will not be responsible for anything that may occur or the information we collect from such a user. Aztek does not knowingly collect information from minors.

12. CHANGES TO THIS POLICY

This Policy is subject to constant changes regarding the information it contains, the information we collect, or any other aspects we deem necessary to modify. If any changes occur, we will post them on the website and the Platform, and we may also notify you; however, you should review them frequently.
